Agreement to these terms
These Terms of Service ("Terms") govern your use of TrackList, operated by TrackList, LLC, a Michigan limited liability company ("TrackList," "we," "us," or "our"). By creating an account or using TrackList, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, do not use TrackList.
Who can use TrackList
You must be at least 13 years old to use TrackList. By using the service, you represent that you meet this requirement.
You must also have a valid Spotify account. TrackList uses Spotify for authentication and music data. If your Spotify account is suspended or terminated, your access to TrackList may be affected.
Account responsibility
Your TrackList account is tied to your Spotify account. You are responsible for all activity that occurs under your account. Do not share your Spotify credentials with others.
You may delete your account at any time from the Settings page. Account deletion is permanent and removes all associated data.
Your ratings, reviews, and tags
You retain ownership of the content you create on TrackList — including ratings, reviews, tags, lists, and concert logs ("User Content").
By submitting User Content, you grant TrackList a non-exclusive, royalty-free, worldwide license to store, display, and distribute that content within the platform for the purpose of operating the service. This license ends when you delete the content or your account.
You are responsible for ensuring your User Content does not violate any third-party rights or applicable laws.
What you may not do
When using TrackList, you agree not to:
- Scrape, crawl, or systematically extract data from TrackList
- Use TrackList data for commercial purposes without our written permission
- Attempt to access another user's account or data
- Post content that is abusive, harassing, defamatory, or otherwise harmful
- Attempt to reverse engineer, modify, or create derivative works of TrackList
- Use TrackList in a way that violates Spotify's Terms of Service or Developer Policy
- Use automated tools (bots, scripts) to interact with TrackList without our written permission
- Attempt to circumvent any security or access controls
Reliance on the Spotify API
TrackList relies on the Spotify Web API to deliver core functionality including authentication, music search, album data, and playlist export. TrackList is not affiliated with or endorsed by Spotify.
Spotify may modify or discontinue their API at any time. If Spotify's API becomes unavailable or restricted, some or all TrackList features may be affected. We are not liable for any such disruption.
Your use of Spotify features within TrackList is also subject to Spotify's Terms of Service.
TrackList is in beta
TrackList is currently in beta. The service is provided as-is and may contain bugs, experience downtime, or undergo significant changes without notice. We make no guarantees about uptime, data availability, or feature continuity during the beta period.
We will make reasonable efforts to preserve your data, but we recommend using the data export feature in Settings to back up your ratings, reviews, and lists periodically.
TrackList's IP
All TrackList branding, design, code, and non-user-generated content is owned by TrackList, LLC. You may not reproduce, distribute, or create derivative works from any TrackList intellectual property without our written permission.
Music metadata, album artwork, and artist information displayed within TrackList is sourced from Spotify, Last.fm, Setlist.fm, and Ticketmaster, and is subject to their respective terms and licenses.
Account termination
We reserve the right to suspend or terminate your account at our discretion if you violate these Terms, engage in harmful behavior, or for any other reason with or without notice.
You may terminate your account at any time from the Settings page. Upon termination, your right to use TrackList ceases immediately.
Limits on our liability
To the fullest extent permitted by law, TrackList, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service.
TrackList is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Our total liability to you for any claims arising from your use of TrackList shall not exceed the amount you paid us (if any) in the twelve months preceding the claim.
Jurisdiction
These Terms are governed by the laws of the State of Michigan, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of TrackList shall be resolved in the courts of Michigan.
Updates to these terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of TrackList after changes are posted constitutes acceptance of the updated Terms.
